Working Hours

General Working Hours

Overtime

Work beyond general hours is overtime and must be paid at 1.5 times the employee’s regular wage rate.

Most employees are paid for overtime, including students, part-time employees, and minimum wage-earners.

Leave

Paid Time Off

Employees who consistently work the same number of hours get 1 regular work day’s pay as general holiday pay. For employees whose hours of work or wages vary, general holiday pay is calculated at 5% of the gross wages (not including overtime) in the 4 week period immediately before the holiday.

Sick Days

The Manitoba Pandemic Sick Leave program provides employers with up to $600 per employee for up to 5 full days of COVID-19 related sick leave, which do not have to be taken consecutively.

Maternity Leave

Maternity leave can begin up to 17 weeks before the expected date of the birth.

Paternity Leave

Up to 18 months after the birth or adoption of a child.

Parental Leave

Parental leave can begin up to 18 months after the birth or adoption of a child. Employees requesting parental leave must give the employer at least four weeks written notice before the leave. Parental leave is now 63 weeks long.

Termination

Termination Process

Employment relationships can be ended by either an employer or employee. In most cases, the legislation requires the person ending the employment to give notice.

Notice Period

An employer in Manitoba, who can terminate your employment at any time and for any reason, must provide you with proper written notice or pay in lieu of notice.

Severance Pay

Federally, the Canada Labour Code also provides for severance pay for employees with 12 months service or more before their layoff or dismissal resulted in the termination of their employment. In this case, employees are entitled to 2 days’ of regular wages for each full year they have worked with a minimum benefit paid of 5 days’ pay.
